Terms & Conditions
These terms explain how driving lessons with PWP Driving School are arranged, paid for and cancelled, together with the responsibilities of both the pupil and instructor.
1. About these terms
These terms apply to driving tuition provided by Paul Walsh trading as PWP Driving School. Pupils should read and understand them before starting tuition.
Lesson prices and available lesson durations are shown on the PWP Driving School website or will be confirmed before tuition is booked.
2. Driving licence and eligibility
The pupil must hold a valid provisional or full driving licence that entitles them to drive the tuition vehicle.
The pupil must provide any information reasonably required to allow their driving entitlement to be checked.
The pupil must also meet the legal eyesight requirement for driving. These requirements may be checked before or during training.
3. Lessons and lesson times
The agreed lesson duration includes the time required for appropriate briefings, feedback and review of progress.
PWP Driving School will make reasonable efforts to start and finish lessons at the agreed times.
If the instructor is significantly late, the lost tuition time will normally be added to the lesson where practical or rearranged at no additional cost to the pupil.
4. Payment
Driving lessons are payable in advance at the price agreed when the lesson or course of lessons is booked.
PWP Driving School will keep appropriate records of lessons paid for and lessons delivered. Advance payments remain attributable to the pupil’s tuition until lessons are provided or a refund becomes due under these terms.
Money paid in advance: paying for lessons in advance does not remove a pupil’s rights to any refund that may properly be due under these terms or applicable consumer law.
5. Cancelling or rearranging a lesson
Cancellation by the pupil
At least 48 hours’ notice is required if a pupil wishes to cancel or rearrange a driving lesson.
Where less than 48 hours’ notice is given, PWP Driving School may charge for the booked lesson because that time has been reserved for the pupil and may not reasonably be capable of being filled at short notice.
Any charge will be applied reasonably, taking account of the circumstances and any costs or losses arising from the late cancellation.
Cancellation by the instructor
If PWP Driving School has to cancel a lesson, the pupil will not be charged for tuition that has not been provided. Any payment already made for that lesson will be credited towards another lesson or refunded where appropriate.
Lessons may occasionally need to be rearranged because of illness, vehicle problems, severe weather, unsafe road conditions or other circumstances outside reasonable control.
6. Refunds and unused lesson credit
Where a pupil has paid for lessons in advance and decides to stop tuition, they should contact PWP Driving School to discuss any unused balance.
Where a refund is due, it will be calculated taking account of lessons already provided and any properly applicable cancellation charges.
PWP Driving School will not retain payment for tuition that it has not provided where there is no lawful basis for doing so.
7. Fitness to drive
The pupil must be fit to drive safely at the start of every lesson. They must tell the instructor about anything that may materially affect their ability to drive safely.
A lesson may be refused or ended where the instructor reasonably believes the pupil is unfit to drive safely, including because of alcohol, drugs, medication, illness, fatigue or another condition affecting safe driving.
The pupil is responsible for following medical and legal requirements relating to their fitness to drive and for notifying DVLA where required.
8. Conduct and safety
The instructor and pupil are expected to behave respectfully and appropriately during tuition.
The instructor may take reasonable action or give direct instruction where necessary to protect the pupil, other road users, the tuition vehicle or property.
PWP Driving School may end tuition where behaviour makes safe or professional instruction impractical.
9. Progress and readiness for the driving test
PWP Driving School will discuss the pupil’s progress and provide guidance about the further training required to achieve their driving goals.
The instructor will advise honestly about whether the pupil is considered ready to take the practical driving test.
A driving test booking does not guarantee that the PWP Driving School vehicle will be made available for that test.
10. Booking and managing the driving test
The pupil is responsible for booking and managing their own Category B (car) practical driving test in accordance with current DVSA rules.
PWP Driving School cannot book, change, swap or cancel a car driving test on behalf of a pupil.
The instructor may provide advice about test readiness, suitable dates and their own availability, and may assist a pupil while the pupil manages their own booking where this is permitted by DVSA rules.
Before booking a test: pupils are strongly encouraged to discuss their readiness and the instructor’s availability before committing to a test appointment.
11. Use of the tuition vehicle for a driving test
Use of the PWP Driving School vehicle for a practical driving test is subject to prior agreement and the instructor being satisfied that the pupil can use the vehicle safely and appropriately for the test.
Paul Walsh reserves the right to refuse the use of the tuition vehicle where, in his professional judgement, allowing its use would present an unacceptable safety risk or the pupil has not demonstrated an appropriate standard of safe and independent driving.
Where concerns arise, they will be discussed with the pupil. If a decision is made to withhold the tuition vehicle, PWP Driving School will aim to provide as much notice as reasonably possible so that the pupil can consider their options and, where possible, avoid losing their DVSA test fee.
Any price and conditions applying to use of the tuition vehicle for the test will be agreed with the pupil in advance.
12. Driving test cancellations and changes
The pupil is responsible for checking the current DVSA rules governing changes and cancellations to their driving test and for taking any required action themselves within the applicable deadlines.
PWP Driving School is not responsible for DVSA cancelling, postponing or changing a test, or for loss of a test fee resulting from action or inaction by the pupil.
13. The tuition vehicle
PWP Driving School will take reasonable steps to provide a roadworthy, appropriately insured and maintained tuition vehicle for lessons.
Occasionally a lesson or test may need to be rearranged because of an unexpected vehicle fault or other circumstances affecting the safe or lawful use of the vehicle.
14. Personal information
Personal information is handled in accordance with the PWP Driving School Privacy Policy.
Information supplied by pupils will only be used and shared where there is an appropriate reason and lawful basis for doing so.
15. Complaints
PWP Driving School aims to provide professional tuition and encourages pupils to raise any concerns as soon as possible so that they can be addressed.
Complaints should initially be made to Paul Walsh at: info@pwpdrivingschool.co.uk .
The complaint will be considered fairly and a reasonable effort will be made to resolve the matter directly with the pupil.
Nothing in these terms affects a pupil’s statutory rights or their ability to raise an appropriate concern with a relevant authority.
16. Ending tuition
Either the pupil or PWP Driving School may decide to end the tuition arrangement.
If tuition ends, any outstanding payment or refund will be dealt with in accordance with these terms and the lessons actually provided.
PWP Driving School may end tuition where there are reasonable grounds to do so, including persistent non-payment, repeated late cancellations, unsafe conduct, abusive behaviour or a breakdown in the professional working relationship.
17. Liability
Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
PWP Driving School cannot guarantee that a pupil will pass a driving test. Test outcomes depend on the pupil’s performance and the independent assessment of the DVSA examiner.
18. Changes to these terms
These terms may be updated where necessary to reflect changes to PWP Driving School’s services, prices, business practices, DVSA requirements or applicable law.
The version applicable to a pupil will be made available to them and material changes affecting existing arrangements will be communicated where appropriate.
